1. ABOUT YOUR SILVER

These Terms & Conditions apply to purchases made through the Your Silver website.

Your Silver is a UK-based online retailer of jewellery-making supplies and findings, supplying both consumers and businesses.

For the purposes of these Terms & Conditions:

"Your Silver", "we", "us" or "our" means Your Silver, operated as a sole trader business.

"You", "your" or "customer" means the person or business placing an order with us.

"Website" means the Your Silver website and any associated pages through which products are offered for sale.

We do not currently provide telephone support. All customer correspondence should therefore be made by email, through the contact forms on our website, or through another communication channel operated by Your Silver where appropriate.

By placing an order through our website, you confirm that you have read and understood these Terms & Conditions.


2. PRODUCTS AND PRODUCT INFORMATION

Your Silver supplies jewellery-making materials, findings, components, beads, chains, wire, charms, packaging products and related supplies.

We aim to ensure that product descriptions, photographs, dimensions and other information displayed on the website are accurate and kept up to date.

However:

- Product photographs are provided for illustrative purposes.
- Colours and appearance may vary slightly depending on photography, lighting, individual screens and device settings.
- Some photographs supplied by manufacturers or wholesalers may have been digitally edited or enhanced for presentation purposes.
- Natural gemstones and other natural materials may vary in colour, pattern, inclusions, markings, shape and appearance. Such variations are a natural characteristic of these materials and do not necessarily constitute a defect.
- Where possible, exact product dimensions are provided on the relevant product page. Minor manufacturing tolerances may occur.
- Products sold by weight, length, quantity or pack size will be supplied according to the relevant option selected at checkout.
- Product quantities, pack sizes, lengths and specifications may vary between products and are stated on the relevant product page where applicable.

We do not manufacture or customise products to individual customer specifications. Products are supplied as pre-existing stock unless expressly stated otherwise.

We reserve the right to update product descriptions, specifications, photographs, prices and availability where reasonably necessary.


3. PRODUCT AVAILABILITY

We make reasonable efforts to ensure that products shown as available on the website are in stock.

However, because Your Silver may sell products through multiple sales platforms, stock levels are not necessarily synchronised in real time. An item may therefore occasionally remain displayed as available after the available stock has been sold elsewhere.

If we are unable to fulfil an order because an item is unavailable, we will contact you as soon as reasonably possible and may cancel the affected order or affected part of the order.

Where an order or part of an order is cancelled because we are unable to supply the goods, any payment taken for the unavailable goods will be refunded using the original payment method.


4. PRICES AND VAT

All prices displayed on the Your Silver website are in British Pounds Sterling (£) and include UK VAT where applicable.

Your Silver is VAT registered and our VAT registration number is 380692084.

Prices may be changed at any time, but changes will not affect an order after a contract has been formed.

We take reasonable care to ensure that prices displayed on the website are accurate. If a genuine pricing error is identified before an order is accepted, we reserve the right to contact you regarding the error and, where appropriate, cancel the affected order and provide a full refund.


5. ORDERING AND CONTRACT FORMATION

Products can be selected and added to your basket before proceeding through checkout.

Before completing your order, you will have the opportunity to review the products, quantities, delivery option and total price and make corrections where necessary.

Payment must be successfully authorised before an order can be processed.

After placing an order, you will receive an automated order confirmation email acknowledging receipt of your order. This email confirms that your order has been received but does not necessarily constitute acceptance of the order.

Unless we notify you otherwise, the contract for the sale of the goods will be formed when we dispatch the order to you.

We reserve the right to cancel an order before dispatch where, for example:

- The product is unavailable.
- There has been a genuine pricing or product-description error.
- We are unable to fulfil the order due to circumstances beyond our reasonable control.
- We reasonably suspect fraudulent or unauthorised activity.

If we cancel an order for a reason for which you are not responsible, you will receive a refund of any payment made for the cancelled goods.


6. PAYMENT

Payment may be made using the payment methods made available at checkout, which may include:

- Debit and credit cards
- PayPal
- Apple Pay
- Google Pay
- Clearpay

Card payments are processed through Wix Payments.

Your Silver does not receive or store your full card payment details.

Payment must be completed before an order can be dispatched.


7. DELIVERY

We currently offer delivery within the United Kingdom using tracked delivery services.

Our standard delivery options currently include:

- Royal Mail Tracked 48 — £2.85
- Royal Mail Tracked 24 — £3.80
- Royal Mail Special Delivery — £9.45

Delivery charges are subject to change in accordance with changes to our courier or postage costs. The delivery options and applicable charges displayed at checkout at the time of ordering will apply to your order.

Free Tracked 24 delivery is currently available on qualifying UK orders over £50.

The delivery service available to you will be displayed at checkout.

At our discretion, we may upgrade an order to a faster or higher-value delivery service at no additional cost where we consider this appropriate.

Orders valued at over £200 may, at our discretion, be sent using a higher level of delivery service, including Special Delivery, even where another service was selected at checkout.

We aim to dispatch orders within 1–2 working days of the order being placed. On rare occasions, a small additional delay may occur where stock needs to be obtained before an order can be completed. If a significant delay is anticipated, we will contact you where reasonably possible.

Once dispatched, UK delivery will typically take approximately 1–2 working days, depending on the delivery service and circumstances affecting the courier.

Delivery times are estimates and are not guaranteed unless expressly agreed otherwise.

We may change our delivery provider or delivery services in the future. If this occurs, the available delivery options and charges shown at checkout will apply to the relevant order.


8. DELIVERY ADDRESS AND DELIVERY PROBLEMS

You are responsible for ensuring that the delivery address provided at checkout is accurate and complete.

We recommend checking your delivery information carefully before completing your order.

We may decline to send orders to certain addresses where we consider the delivery arrangements unsuitable or unreliable, including certain PO Boxes or similar addresses where the selected delivery service cannot provide the required tracking or delivery confirmation.

If an order appears to have been delivered to an incorrect address, we will contact the relevant courier or postal service and take reasonable steps to assist in resolving the matter.

Where Royal Mail is used, delivery information and GPS-related delivery records may be available to assist with investigating delivery disputes.

If a parcel is confirmed as lost or has not been delivered, we will contact the courier on your behalf and take reasonable steps to assist in resolving the matter.

If a parcel has been incorrectly delivered and the matter has not been resolved by the courier within a reasonable period, we will work with you to determine an appropriate resolution.

Nothing in these Terms & Conditions affects your statutory rights in relation to delivery or non-delivery of goods.


9. INTERNATIONAL ORDERS

Your Silver currently focuses primarily on UK delivery.

Where international delivery is offered, the available destinations, delivery services, charges and any applicable terms will be displayed at checkout.

Customers placing international orders are responsible for complying with applicable import requirements and for any customs duties, taxes, import charges or other fees imposed by the destination country, unless expressly stated otherwise at checkout.

International delivery terms may be updated as our international shipping arrangements develop.


10. RETURNS AND CANCELLATION RIGHTS

If you are a consumer, you have statutory rights when purchasing goods online, including a statutory right to cancel most distance contracts without giving a reason.

For eligible consumer purchases, you normally have 14 days from the day after you receive the goods to notify us that you wish to cancel the contract.

After notifying us of cancellation, you normally have a further 14 days to return the goods.

Please provide your order number and clearly state that you wish to cancel your order.

Goods should be returned safely and securely packaged.

You are responsible for the direct cost of returning goods when cancelling an order under the statutory cancellation right, unless the goods are faulty, damaged, incorrect, or we are otherwise responsible for the return.

Where appropriate, we may withhold a refund until the goods have been returned or you have provided reasonable evidence that they have been returned.

Where permitted by law, we may make a deduction from a refund where goods have been handled beyond what is reasonably necessary to establish their nature, characteristics and functionality and their value has consequently been diminished.

Where a consumer exercises the statutory cancellation right, we will refund the cost of standard delivery. Where a more expensive delivery service was selected, we are generally only required to refund an amount equivalent to the least expensive standard delivery option offered.

The statutory cancellation right does not prevent you from exercising any separate rights you may have where goods are faulty, damaged, incorrectly supplied or otherwise do not comply with your legal rights.


11. ITEMS THAT CANNOT BE RETURNED IN THEIR SUPPLIED CONDITION

Because our products are primarily jewellery-making supplies and components, goods must be returned in the same condition in which they were supplied.

We cannot accept a return for a change of mind where the product has been:

- Assembled into jewellery or another item.
- Cut, altered, modified or customised.
- Damaged after delivery.
- Used in a way that goes beyond reasonable inspection.
- Mixed with other products in a manner that prevents identification.
- Otherwise changed from the condition in which it was supplied.

This does not affect your statutory rights where goods are faulty, damaged, incorrectly supplied or otherwise do not conform to the contract.


12. RETURNS INSPECTION

Returned goods may be inspected before a refund or replacement is provided.

Where appropriate, we may check that the returned goods correspond with the products supplied and that the quantity, weight, length, size and general condition are consistent with the original order.

This may include checking products such as:

- Beads and findings
- Wire
- Chain
- Gemstones
- Charms
- Components
- Packaging materials
- Products sold by weight, length or quantity

These checks are intended to protect both the customer and Your Silver against accidental or fraudulent discrepancies.


13. FAULTY, DAMAGED OR INCORRECT GOODS

If you receive goods that are faulty, damaged in transit, not as described, or different from those ordered, please contact us as soon as reasonably possible at sales@yoursilver.shop.

Please provide your order number and, where useful, photographs or other information that may help us investigate the problem.

We will investigate the issue and, where appropriate, provide a suitable remedy in accordance with your statutory rights.

Depending on the circumstances, this may include a replacement, repair, price reduction or refund.

If the problem is our responsibility, we will cover reasonable return postage costs and may provide a pre-paid return label where appropriate.

Nothing in these Terms & Conditions limits or excludes your statutory rights in relation to faulty, damaged, misdescribed or incorrectly supplied goods.


14. REFUNDS

Where a refund is due, it will normally be made using the same payment method used for the original transaction.

We do not normally make refunds to a different payment method unless this is necessary or agreed for a particular reason.

Refund processing times may vary depending on the payment provider or financial institution involved.

Where a statutory cancellation applies, refunds will be processed in accordance with applicable consumer law.


15. BUSINESS CUSTOMERS

Your Silver supplies products to both consumers and businesses.

Where an order is placed by a business for purposes relating to its trade, business, craft or profession, the customer may have different legal rights from those applying to a consumer.

Nothing in these Terms & Conditions is intended to exclude or restrict any rights or remedies that cannot legally be excluded or restricted.

Business customers should ensure that products are suitable for their intended application before purchase and should inspect goods upon receipt.


16. USE OF JEWELLERY-MAKING COMPONENTS AND MATERIALS

Our products are supplied primarily as materials and components for use in jewellery making and related crafts.

Unless expressly stated otherwise, products are not finished jewellery items and are not supplied as assembled or customised products.

Customers are responsible for determining the suitability of any component or material for their intended use and for ensuring that their finished products are safely and appropriately constructed.

Where a product is intended to be incorporated into another item, the customer is responsible for appropriate assembly, construction and testing of the finished product.

Any information provided by Your Silver regarding the general characteristics or possible uses of a product is provided for guidance and does not constitute a guarantee that the product is suitable for a particular finished product or application.


17. NATURAL GEMSTONES AND MATERIALS

Natural gemstones and other natural materials may contain natural variations, inclusions, markings, colour differences and other characteristics.

Products made from natural materials may therefore differ from photographs or from one another.

Such natural variation does not necessarily indicate that a product is defective.

Where an individual product is particularly unusual or has characteristics that materially affect its description, we will endeavour to provide appropriate information on the relevant product page.


18. PRODUCT ERRORS AND DISCREPANCIES

If you believe that you have received an incorrect product, incorrect quantity, incorrect size, incorrect length or another order discrepancy, please contact us as soon as reasonably possible.

We will investigate the matter using the order information and, where appropriate, our dispatch records.

Where we have made an error, we will take reasonable steps to correct it and provide an appropriate remedy.

Customers should not return goods at their own expense where we have specifically instructed them that we will provide a pre-paid return method.


19. INTELLECTUAL PROPERTY

The Your Silver name, logo, branding, website design, original written content, photographs, graphics and other material created or used by Your Silver may be protected by intellectual property rights.

You may not reproduce, copy, modify, distribute, publish, sell, commercially exploit or otherwise use Your Silver branding, logo or original website content without prior written permission, except where permitted by law.

Product information supplied by manufacturers, wholesalers or other third parties may remain the property of those respective parties.

Some product descriptions may be written by Your Silver, while others may be adapted from information supplied by manufacturers, wholesalers or other legitimate sources.


20. WEBSITE CONTENT AND AVAILABILITY

We make reasonable efforts to ensure that the information contained on the website is accurate and current.

However, we do not guarantee that the website will always be available, uninterrupted, error-free or completely free from technical problems.

We may modify, suspend or discontinue parts of the website, including products, features or content, where reasonably necessary.

Nothing in this section limits any rights you have under applicable consumer law.


21. EXTERNAL WEBSITES AND THIRD-PARTY SERVICES

The Your Silver website may contain links to external websites or services operated by third parties.

These links are provided for convenience or additional information.

We are not responsible for the content, availability, security, privacy practices or operation of external third-party websites.

Use of third-party websites and services may be subject to their own terms and conditions and privacy policies.

Payment services and other third-party services used to process orders may also operate under their own terms and privacy policies.


22. LIMITATION OF LIABILITY

Nothing in these Terms & Conditions excludes or limits liability where doing so would be unlawful.

In particular, nothing in these Terms & Conditions excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot legally be excluded or limited.

We are not responsible for losses that are not reasonably foreseeable or for losses arising from circumstances outside our reasonable control, subject always to your statutory rights.

Where products are purchased for business purposes, we will not be liable for indirect or consequential business losses such as loss of profits, loss of business, loss of opportunity or business interruption except where such liability cannot lawfully be excluded.

Nothing in these Terms & Conditions affects a consumer's statutory rights.


23. EVENTS OUTSIDE OUR REASONABLE CONTROL

We will not be responsible for delays or failures to perform our obligations where these are caused by circumstances beyond our reasonable control.

Such circumstances may include, for example:

- Severe weather
- Natural disasters
- Fire
- Flood
- Power or telecommunications failures
- Industrial disputes
- Significant courier or postal disruption
- Government restrictions
- Disruption to suppliers
- Cyber incidents
- Other events that could not reasonably have been prevented or anticipated

Where such circumstances occur, we will take reasonable steps to minimise any resulting disruption and will communicate with affected customers where appropriate.


24. COMPLAINTS

We aim to provide a high standard of customer service and would always prefer to resolve any problem directly with you.

26. CHANGES TO THESE TERMS & CONDITIONS

We may update these Terms & Conditions from time to time, for example where our business practices, website functionality, delivery arrangements or legal requirements change.

The version of the Terms & Conditions applicable to an order will be the version in force at the time the relevant contract is formed.

The date at the beginning of this document indicates when these Terms & Conditions were last updated.


27. GOVERNING LAW AND JURISDICTION

These Terms & Conditions and any contract between you and Your Silver are governed by the laws of England and Wales, subject to any mandatory rights or protections that apply to consumers in their place of residence.

If you are a consumer, you will retain any mandatory legal rights available to you under the laws that apply to your circumstances.

Where a dispute cannot be resolved through direct communication, the appropriate courts will have jurisdiction in accordance with applicable law.


28. SEVERABILITY

If any provision of these Terms & Conditions is found to be invalid, unlawful or unenforceable, that provision will be treated as modified or removed to the extent necessary, and the remaining provisions will continue to apply.


29. ENTIRE AGREEMENT

These Terms & Conditions, together with the information provided on the relevant product pages, the checkout information, our Delivery Information, Returns & Refunds information, Privacy Notice and Cookie Policy, form the relevant terms governing your use of the website and purchase of products from Your Silver.

Nothing in these Terms & Conditions is intended to remove or reduce any statutory rights that cannot legally be excluded.
